Self-certification declaration question clarification

See below for further clarification on each article within the declaration:

Within the Self-Certification Declaration, Question 1 reads:

'Does Your Organization have all of the licenses and registrations that are required of it by all relevant regulatory authorities in its governing jurisdiction and is Your Organization in compliance with the laws and regulations applicable to it?'

Answering "No" would mean that your organization does NOT have all the licenses and registrations that are required of it by all relevant regulatory authorities in its governing jurisdiction and/or is NOT in compliance with the laws and regulations applicable to it.

Answering "Yes" would mean your organization does have all the licenses and registrations that are required of it by all relevant regulatory authorities in its governing jurisdiction and/or is in compliance with the laws and regulations applicable to it.

Within the Self-Certification Declaration, Question 2 and Question 2(a) read:

Does Your Organization discriminate against any person or group of people in its hiring and employment practices, codes of conduct, programs, services or in any other aspect of its operations or activities on the basis of that person or group of people's personal characteristics or attributes?

For clarity, 'discrimination' in this Question includes (but is not limited to) hiring and employment policies or practices that discriminate against a person or group of people on the basis of their sexual orientation or gender identity, even if such policies and practices are permitted under applicable law.'

Answering "Yes" would mean that your organization does discriminate against people/groups in your hiring practices, conduct, programs, services or in any other aspect of your operations or activities on the basis of that person or group of peoples personal characteristics or attributes. 

Answering "No" would mean that your organization does NOT discriminate against people/groups in your hiring practices, conduct, programs, services or in any other aspect of your operations or activities on the basis of that person or group of people's personal characteristics or attributes. 

'2(a) Is Your Organization a religious or faith-based organization exempt from applicable laws that otherwise prohibit such Discrimination?'

Answering "Yes" would mean that your organization is a religious or faith-based organization exempt from applicable laws that otherwise prohibit such discrimination.

Answering "No" would mean that your organization is NOT a religious or faith-based organization exempt from applicable laws that otherwise prohibit such discrimination.

Within the Self-Certification Declaration, Question 3 reads:

‘Will your organization apply donations only to non-religious programs (unless special written permission has been received from Benevity or the applicable Benevity client)?’

  • Answering “Yes” would mean your organization is able to separate funds received via Benevity and apply them only to non-religious programming. Even if religious, if you can separate Benevity donations to spend only on non-religious programs, you can answer “Yes”.
  • Answering “No” would mean your organization is NOT able to separate funds received via Benevity and apply them only to non-religious programming. If you are a religious organization and are unable to separate Benevity donations from how you spend funds (ie. all money is spent on religious programs) then you will need to answer “No”.

Within the Self-Certification Declaration, Question 4 reads:

'Does Your Organization support or sponsor political campaigns or otherwise advocate for (or against) political candidates?'

Answering "Yes" would mean that your Organization DOES support or sponsor political campaigns or otherwise advocate for (or against) political candidates.

Answering "No" would mean that your Organization DOES NOT support or sponsor political campaigns or otherwise advocate for (or against) political candidates.

Within the Self-Certification Declaration, Question 5 and Question 5(a) read:

5 Your Organization will not lobby a federal, state or local government agency or government official except where and only to the extent permitted under applicable laws.’

Answering "No" would mean that you WILL lobby a federal, state or local government agency or government official.

Answering "Yes" would mean that you WILL NOT lobby a federal, state or local government agency or government official.

'5(a) Your Organization does not allocate more than 25% of time devoted (volunteers and staff) and 25% of your budget towards lobbying efforts.'

Answering "No, I Do Not Agree" would mean that you DO in fact allocate more than a quarter of your time and budget towards lobbying efforts.

Answering "Yes, I Agree" would mean that you DO NOT allocate more than a quarter of your time and budget towards lobbying efforts.

Within the Self-Certification Declaration, Question 6 reads:

'Your Organization will not use Benevity Donations to bribe any government or public official, unlawfully gain an advantage in political or legal proceedings or unlawfully solicit business.'

Answering 'No' would mean that you WILL in fact use Benevity Donations to bribe a government or public official, unlawfully gain an advantage in political or legal proceedings or unlawfully solicit business.

Answering 'Yes' would mean that you WILL NOT  use Benevity Donations to bribe a government or public official, unlawfully gain an advantage in political or legal proceedings or unlawfully solicit business.

Within the Self-Certification Declaration Question 7 reads:

'Your Organization will not attempt to unlawfully or improperly influence a Benevity Client or any individual donor.'

Answering 'No, I Do Not Agree' would mean that you WILL in fact attempt to unlawfully or improperly influence a Benevity Client or any individual donor.

Answering 'Yes, I Agree' would mean that you WILL NOT attempt to unlawfully or improperly influence a Benevity Client or any individual donor.

Within the Self-Certification Declaration Question 8 reads:

'Your Organization will not identify any Benevity Client as a donor or use a Benevity Client's logo or brand for promotional purposes without prior written consent of that Benevity Client.'

Answering 'No, I Do Not Agree' would mean that you WILL in fact identify one or more Benevity Clients as a donor or use a Benevity Client's logo or brand for promotional purposes without prior written consent of that Benevity Client.

Answering 'Yes, I Agree' would mean that you will NOT identify one or more Benevity Clients as a donor or use a Benevity Client's logo or brand for promotional purposes without prior written consent of that Benevity Client.

Within the Self-Certification Declaration Question 9 reads:

'Your Organization will return Benevity Donations that it knows or should know are ineligible under applicable law or Benevity Client guidelines or were provided in error. This obligation is in addition to (and does not supersede) Your Organization's responsibilities set out in the Benevity Causes Portal Terms of Use.'

Answering 'No, I Do Not Agree' would mean that you will NOT return Benevity Donations that your organization knows or should know are ineligible under applicable law or Benevity Client guidelines or were provided in error.

Answering 'Yes, I Agree' would mean that you will return Benevity Donations that your organization knows or should know are ineligible under applicable law or Benevity Client guidelines or were provided in error.

Within the Self-Certification Declaration, Question 10 reads:

'As far as you are aware, Your Organization does not employ or engage any person or entity who appears or has appeared on any restricted party list, including without limitation, anti-terrorism, anti-money laundering, anti-bribery or other similar 'watch list' such as the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), Specially Designated Nationals List, the EU Consolidated List and the OSFI Consolidated List. Your Organization agrees to notify Benevity as soon as possible if it is no longer able to make this statement..'

Answering 'No, I Do Not Agree' would mean that your Organization DOES employ or engage any person or entity who appears or has appeared on any restricted party list, including without limitation, anti-terrorism, anti-money laundering, anti-bribery or other similar 'watch list' such as the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), Specially Designated Nationals List, the EU Consolidated List and the OSFI Consolidated List.

Answering 'Yes, I Agree' would mean that your Organization does NOT employ or engage any person or entity who appears or has appeared on any restricted party list, including without limitation, anti-terrorism, anti-money laundering, anti-bribery or other similar 'watch list' such as the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), Specially Designated Nationals List, the EU Consolidated List and the OSFI Consolidated List.

Within the Self-Certification Declaration, Question 11 reads:

'If a Benevity Client requests that a Benevity Donation be used for a particular charitable purpose or project that are among Your Organization's existing programs or projects, Your Organization agrees to honour such request as best you can.'

Answering 'No, I Do Not Agree' would mean that you would NOT honour a Benevity Client's request that a Benevity Donation be used for a particular charitable purpose or project that are among Your Organization's existing programs or projects.

Answering 'Yes, I Agree' would mean that you would honour a Benevity Client's request that a Benevity Donation be used for a particular charitable purpose or project that are among Your Organization's existing programs or projects.

Within the Self-Certification Declaration, Question 12 reads:

'If Your Organization receives a Benevity Donation from a Benevity Client in the form of a restricted grant via a grants management product executed through the Platform (called, "Grants"), Your Organization agrees to follow any instructions from the Benevity Client that accompanies such Grant. If Your Organization cannot follow those instructions, Your Organization agrees to return that Benevity Donation.' 

Answering 'No, I Do Not Agree' would mean that your organization does NOT agree to follow instructions from the Benevity Client/Donor that accompanies such Grants and would NOT agree to return that Benevity Donation if you aren't able to follow said instruction.

Answering 'Yes, I Agree' would mean that your organization does agree to follow instructions from the Benevity Client/Donor that accompanies such Grants and would agree to return that Benevity Donation if you aren't able to follow said instruction.

Within the Self-Certification Declaration, Question 13 reads:

'Your Organization will not re-grant Benevity Donations to organizations that are not able to provide the same responses as have been provided in this Declaration.'

Answering 'No, I Do Not Agree' would mean that you WILL ​re-grant Benevity Donations to organizations that are not able to provide the same responses as have been provided in this Declaration.

Answering 'Yes, I Do Agree' would mean that you WILL NOT ​re-grant Benevity Donations to organizations that are not able to provide the same responses as have been provided in this Declaration.
