How do the Foreign Contribution (Regulation) Amendment Rules, 2026 affect my nonprofit?

On June 22, 2026, India's Ministry of Home Affairs published the Foreign Contribution (Regulation) Amendment Rules. From that date, nonprofits in India that receive foreign funds must report originating donor details (name, address and email address) about each donor. Benevity is committed to aligning our platform to any applicable regulations. While we build this functionality in the platform to capture new and previous donations, you may find that disbursements to your organization are noted as anonymous. If you prefer not to receive disbursements until this functionality is complete and covers both new and previous donations, contact the Nonprofit Support team to pause disbursements from all foundations we work with. However, your nonprofit can stay active on the Benevity platform allowing you to continue receiving foreign funds from the foundations Benevity works with.

Note: This article is for general information only and is not legal advice. We recommend consulting your own legal advisor to understand how these rules apply to your organization.

What changed under the amended rules?

For each foreign contribution, nonprofits in India must report the donor's name, address, and email, as well as the amount of the donation even when a disbursement is received from another charitable organization. This requirement comes from India's Foreign Contribution (Regulation) Act (FCRA).

Does this apply to my nonprofit?

If your organization is a registered nonprofit based in India and eligible to receive foreign funds (via your FCRA registration), then this change applies to you. The Benevity platform facilitates disbursements from The UK Online Giving Foundation (UKOGF), which is a charitable foundation established in England and Wales that receives donations from donors globally and makes disbursements to nonprofits for charitable purposes globally, including to registered nonprofits in India.

It does not directly affect local disbursements within India from Online Giving Foundation, which is established in India.

How is donor information shared?

Benevity, on behalf of the foundations we work with, shares donor information with your nonprofit only when the donor consents to sharing that information with the recipient nonprofit. Consent is collected at the time of donation to the foundation.

For new donations made to UKOGF recommending nonprofits in India on or after October 27, 2026:

  • Donation form update: Donors recommending your nonprofit now see a notice on the donation form that their name, email address, address and donation details are shared with the recipient nonprofit. In order to recommend disbursement to your nonprofit, donors must agree to share this information. They can no longer choose to share less.
  • You can find donor information in the donor and company fields on your disbursement report.

We are working on a solution to support donations made from June 22 until the form update (October 27), with the aim of obtaining the donor consent needed to share applicable donor details. Please follow this article by selecting the ‘Follow’ button at the top of the page in order to receive a notification when this functionality is live.

What appears on reports for corporate donations, matches, rewards, and grants?

For corporate donations, including donation matches, employee rewards, and grants, your disbursement report shows the company name and postal or ZIP code. We’re reviewing how to support your reporting needs for corporate donations and will update this article when we have more to share. You can identify corporate donations versus employee contributions by using the Reporting Glossary.
